This portal is provided as a public service by the National Land Agency (NLA) of the Government of Jamaica.

By accessing this platform/site, you hereby agree to the Terms and Conditions of this portal.

Sections of this portal are reserved solely for individuals authorized by NLA SMD. Unauthorized access to these sections is strictly prohibited and may result in legal action against individuals or entities in breach.

LIMITATION OF LIABILITY

The NLA SMD will not be liable to any person, business or entity for any (including but not limited to direct, indirect, special, incidental or consequential) damages, inconveniences, expenses, profits or claims whatsoever (including, but not limited to claims in contract, negligence or tort) arising from or in connection with the Licensee’s use, misuse, alteration or reproduction in any way of the product/website/platform.

TERMS OF USE REVISIONS

The NLA SMD may at any time, without prior notice revise these Terms of Use via updates to this document and as such will be subject to any and all said changes. By using this site/platform, you agree to be bound by any such revisions and should periodically visit the page to be aware of the then current Terms of use to which you are bound.

CONTENT

It is the purpose of the NLA SMD website to provide accurate content that will inform and educate users through access to Basic Property Search, Advanced Property Search, and Interactive Map. In addition, the website/platform is used to facilitate, where appropriate, the delivery of direct services as provided by the NLA SMD to its customers.

The Surveys & Mapping Division intends to maintain current and accurate information on its website. As information changes on a daily basis however, information may become temporarily outdated pending the receipt, scanning and posting of relevant updates, or may be changed without the knowledge of the NLA SMD. Consequently, the NLA SMDcannot expressly warrant the accuracy of its website content on a daily basis.

SECURITY

Our web site/platform has security measures in place to protect the loss, misuse, and alteration of the information under our control. Only select employees of the NLA SMD have access to the information you provide to us. Said employees have access only for data analysis and quality control purposes.

TRANSACTION SECURITY

The NLA SMD aims to provide a safe and convenient online shopping experience. When you make a purchase using our platform, we endeavor to safeguard the integrity of your credit card information.

If you are submitting personal details including credit card numbers, or other information via the internet which you wish to remain private, do note that, while all attempts are made to secure information transmitted to this website, there is the possibility that information submitted maybe viewed and/or detected by a third party while in transit.

If you are uncomfortable doing business online you may make your payment at the office of the Surveys & Mapping Division, Jamaica and do business at the said address. Customer Service Representatives will assist you.

“AS IS” SERVICE

The NLA SMD will not always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data or personalization settings, or other service interruptions. For this reason, you agree that the service is provided "As-Is", without warranties of any kind. The department does not assume responsibility for timeliness, errors or inaccuracies, deletion, missed delivery, or failure to store any user data, communications or personalized settings.

ERRORS AND QUESTIONS

In case of errors or questions about any transaction, a user should notify us as soon as possible via one of the following:

If any user thinks the transaction and/or document viewed is incorrect or contains an error, said user must contact the NLA SMD as aforementioned within seven (7) business days of the transaction. Such a user must:

  • communicate both their name and account number;
  • describe the error or the transaction in question, and explicitly state why you believe it is an error or why more information is needed; and, any user, who verbally contacts the NLA SMD, may be required to express such complaint in writing.

ACCOUNT NUMBER AND PASSWORD

A user of this platform will be asked to select a password when registering. This user is responsible for maintaining the confidentiality of his/her password and account number. Users are fully responsible for all activities that occur using their password or account number. The Surveys & Mapping Division will not be liable for any damage or loss that may be incurred as a result of the use of passwords or account numbers, whether with or without the user’s knowledge.

The user agrees to immediately notify the Surveys & Mapping Division of any unauthorized use of the password or account or any breach of security.

The NLA SMD will not be liable for any loss or damage arising from the user’s failure to comply with this Section.

DISCLAIMER

EXCEPT EXPRESSLY STATED IN AN AGREEMENT BETWEEN THE USER AND THE SURVEYS AND MAPPING DIVISION, ALL CONTENT, SERVICES, PRODUCTS AND SOFTWARE PROVIDED ON THIS WEBSITE/PLATFORM ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. THE SURVEYS AND MAPPING DIVISION, THE GOVERNMENT OF JAMAICA, ITS LICENSORS AND PROVIDERS OF DATA, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED INCLUDING WITHOUT LIMITATION THOSE OF ACCURACY, COMPLETENESS, CURRENCY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. NLA SMD MAKES NO GUARANTEE THAT:

  • THE SERVICE WILL MEET THE USERS REQUIREMENTS.
  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  • THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, COMPLETE, CORRECT OR RELIABLE.

INDEMNITY

The user agrees to indemnify and hold the Surveys & Mapping Division, the Government of Jamaica, affiliates, officers, agents, co-branders and other partners, and employees, harmless from any claims or demands including claims for attorneys’ fees, made by any third party due to or arising out of use of and/or connection to the website/platform, violation of the Terms of Use, or violation of the rights of another, or violation of any copyright law or any other applicable laws.

REGISTRATION CONSIDERATIONS

In consideration of the use of this website/platform, the user agrees to:

  • provide true, accurate, current and complete information as required (Registration Data) and;
  • maintain and promptly update the registration data to keep it true, accurate, and complete.

If any untrue, inaccurate, out of date or incomplete information is provided, or the Surveys & Mapping Division has reasonable grounds to suspect that information is untrue, inaccurate, out of date or incomplete the Surveys & Mapping Division has the right to suspend or terminate the account and refuse any and all current or future use of the website/platform (or any portion thereof).

NLA SMD will not be liable for any loss or damage arising from the user’s failure to comply with this Section.

UNLAWFUL ACTIVITY

Users agree not to use the service provided for illegal purposes or for the transmission of material that is or may be unlawful, harassing, libelous (untrue and damaging to others), invasive of another's privacy, abusive, threatening, obscene, or that infringes the rights of others. The NLA SMD may immediately discontinue the service if it believes anyone uses its services in such a manner and/or for such purposes.

ADDITIONAL TERMS AND CONDITIONS

Users cannot use the data or databases for soliciting other persons for any purpose, including any form of marketing or telemarketing, or aggregate the data for any purpose.

The Government of Jamaica owns the data and databases: the user is granted a non-exclusive right to use the data only and is not granted any ownership rights to any content in the site.

Users are required to keep all personal, commercial and proprietary information, including all passwords and access codes, provided through this service strictly confidential and to maintain adequate security to protect such confidentiality at all times.

The Surveys & Mapping Division may terminate any user’s access to this service for non-compliance with any term and condition, for non-compliance with legislation or Government policy, or for non-payment of license fees on giving such notice as it determines.

Any material downloaded or otherwise obtained through the use of the website/platform is done at the users’ own discretion and risk, and the user will be solely responsible for any damage to the users’ computer system or loss of data that results from the download of such material.

Users agree not to use the NLA SMD domain name as a pseudonymous return email address for any communication that the user transmits from another location or through another website or service; and may not pretend to be someone else, or prove their identity when using the website.

Users may submit comments and provide suggestions so long as such comments or suggestions are not obscene, illegal, threatening, and/or defamatory and so long as any information submitted does not invade the privacy or infringe the intellectual property of a third party. Further, such submitted information may not contain software viruses, malware, mass mailing, chain letters, or any form of spam. You may not use any false email address, impersonate any person or entity, or otherwise mislead as to the origin of the information.

ENFORCEMENT OF TERMS AND CONDITIONS

The failure of the Surveys & Mapping Division to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions, if found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the other provisions of the Terms and Conditions remain in full force and effect.

The section titles in the Terms and Conditions are for convenience only and have no legal or contractual effect.

FORCE MAJEURE

Users agree that the Surveys & Mapping Division is not responsible for delays, damages or failures in performance due causes beyond the department of lands and surveys’ reasonable control including but not limited to acts of government bodies, acts of God, acts of third parties, floods, other weather related incidents, strikes or labour related disturbances or an inability to obtain equipment or services.

COPYRIGHT

The licensed Website, domain name and all graphic designs, style templates, icons, HTML code, programming code and other graphic elements incorporated therein are the exclusive property of the Government of Jamaica (represented by the Surveys & Mapping Division).

The Jamaican Government (represented by the Surveys & Mapping Division) owns all right, title and interest in and to the Surveys & Mapping Division trade names, service marks, copyrights, and know-how relating to the design, function or operation of the Website and any other rights not specifically granted herein. To the extent any trade names, trademarks or other proprietary marks or intellectual property of third parties (“Third Party marks”) are incorporated into any component of the subscription service or website, such Third Party marks are the intellectual property of such third parties.

Where users are entitled to print, reproduce or publish any document containing or comprising any Information, any such print, reproduction or publication shall be under the copyright of the Jamaican Government and shall contain, in legible print, the following acknowledgment: Surveys & Mapping Division, Jamaican Government. All Rights Reserved and attribution as specified on the Website's Attribution Guidance Page.

Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, whether for commercial gain or otherwise, without the prior written permission of the Surveys & Mapping Division or the copyright owner. You also may not, without permission from the NLA SMD, "mirror" any material contained on this website/platform on any other server. Any unauthorized use of any material contained on this website/platform may violate intellectual property laws and other statutes.

RESTRICTIONS OF USE

If you are accessing or using this website/platform as part of your duties as an employee of a corporation or other legal entity, you hereby represent and warrant to the Surveys & Mapping Division that you are authorized to act on behalf of such corporation or legal entity and bind the same to these terms. All rights and licenses granted are personal to you and shall not include any right to grant sublicenses to any third party except as expressly set forth in the Licence Agreement.

APPLICABLE LAW

The terms of use shall be governed by and construed in accordance with Jamaican laws, which shall be the exclusive jurisdiction for any claim or action arising out of or relating to these Terms or the use of the website/platform. Any such claim or action shall be filed only in the courts of Jamaica and you will submit to the jurisdiction of such courts for the purpose of litigating any such claim or action.

Those who choose to access this Website from outside Jamaica do so on their own initiative and are responsible for compliance with applicable local laws.
